Berry Springs Lodge Annual Membership Terms & Conditions

Effective Date: October 1, 2025

1. Membership Overview

Your Annual Unlimited Stay Membership provides access to Berry Springs Lodge accommodations for one calendar year from activation date, subject to availability and these terms.

2. Stay Limits & Reasonable Use

• Maximum Stay Length: 7 consecutive nights per reservation
  • After 7 nights, you must check out for at least 1 night before rebooking
  • Ensures fair access for all members and prevents extended residence

• Annual Night Limit: Up to 120 nights per membership year
  • This guideline ensures fair-use access for all members
  • Most members will never approach this limit
  • Requests beyond 120 nights may be accommodated on a case-by-case basis at Berry Springs’ discretion

• Booking Limits: Maximum of 3 active future reservations at any time
  • Additional reservations can be made once current ones are completed or canceled
  • Prevents monopolizing available inventory

• Advance Booking: Members may book up to 1 year in advance
  • Priority booking (30 days before general public) applies to available dates only

3. Booking & Availability

Availability: Stays are subject to room availability at time of booking

• "Unlimited" refers to frequency of stays, not guaranteed availability
• Berry Springs reserves the right to manage inventory for operational needs

Reservation Requirements:

• Minimum 24-hour advance booking required
• Standard Check-in: 4:00 PM | Check-out: 11:00 AM
• Members receive complimentary early check-in and late check-out upon availability
• Valid government-issued ID required at check-in

Cancellations:

• Free cancellation up to 24 hours before check-in
• Late cancellations (less than 24 hours) count as violations
• No-shows forfeit the reservation and count as violations

Excessive Cancellation/No-Show Penalties:

• First 3 violations per year: Warning only
• 4th-6th violations: $50 penalty fee per incident
• 7th-9th violations: $100 penalty fee per incident + 30-day booking restriction
• 10+ violations: Membership review and potential termination
• Violations reset annually on membership renewal date
• Penalty fees must be paid before making new reservations

4. Membership Benefits & Restrictions

Included:

• Accommodation only (standard room amenities)
• Access to common areas and facilities
• 15% discount on all on-site purchases

NOT Included:

• Meals, spa services, activities (available at member discount rate)
• Room service, premium amenities, or special requests
• Cleaning fees for excessive mess or damage

Gift Card & Guest Passes:

• $1,000 gift card activated upon membership purchase
• VIP guest passes valid for one calendar year from membership activation
• Guest passes are non-transferable and cannot be resold

5. Member Responsibilities

Property Respect:

• Members are responsible for damages beyond normal wear and tear
• Smoking only in designated areas (charges apply for violations)
• Quiet hours: 10:00 PM - 8:00 AM

Guest Limits:

• Maximum occupancy per room as posted
• All guests must be registered at check-in
• Member must be present for entire duration of guest stays

Commercial Use Prohibited:

• Membership is for personal leisure use only
• No subletting, Airbnb listing, or commercial use of any kind
• Violation results in immediate membership termination

6. Membership Term & Renewals

Initial Term: 12 months from activation date

Renewal: Automatic annual renewal at current membership rate unless canceled

Cancellation: 30-day written notice required to prevent auto-renewal

Rate Protection: Founding members lock in their rate for life (renewals at same price)

7. Refund & Guarantee Policy

Love It or Leave It Guarantee:

• Full refund available within 30 days of first stay OR 90 days of membership purchase, whichever comes first
• This ensures you have time to try the membership or get your money back if you haven't stayed yet
• Must provide written feedback on experience
• Refund processed within 10 business days

No Refunds After Guarantee Period:

• Memberships are non-refundable after guarantee period
• No pro-rated refunds for unused portions
• Membership benefits cannot be paused or extended

8. Termination & Violations

Immediate Termination (No Refund):

• Commercial use of membership
• Damage to property or harassment of staff/guests
• Violation of booking limits or stay duration rules
• Any illegal activity on property
• Excessive cancellations/no-shows (10+ violations in membership year)

Written Warning System:

• First violation: Written warning and education
• Second violation: 30-day membership suspension
• Third violation: Permanent termination without refund

9. Limitations & Disclaimers

No Guarantee of Availability:

• Peak dates may have limited availability despite member priority
• Maintenance, weather, or emergencies may affect availability
• Berry Springs will make reasonable efforts to accommodate but cannot guarantee specific dates

Property Changes:

• Berry Springs reserves right to make operational changes, renovations, or improvements
• Temporary closures for maintenance do not extend membership term

10. General Terms

Membership Transfer:

• Memberships are non-transferable and non-assignable
• Only the named member and registered guests may use benefits

Changes to Terms:

• Terms may be updated with 30-day written notice to members
• Continued use of membership constitutes acceptance of changes

Governing Law:

• These terms are governed by Tennessee state law
• Any disputes resolved in Sevier County, Tennessee
